RUMR Terms of Service

These Terms of Service ("Terms") are an agreement between you and Enovate Consulting, Inc. ("RUMR", "we", "us"), the US company that operates the RUMR app and related services (the "Service"). By creating an account or using RUMR, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use RUMR.
These Terms replace all earlier RUMR terms of use.
1. Who can use RUMR
- You must be at least 13 years old to use RUMR.
- If you are 13 to 17, you must have permission from a parent or legal guardian, and they must agree to these Terms for you. Parents and guardians are responsible for their teen's use of RUMR.
- You cannot use RUMR if we have previously banned you, or if you are barred from using services like RUMR under the laws that apply to you.
If we learn that someone under 13 has an account, we will delete it.
2. Your account
Signing in. You can create an account and sign in with:
- Your mobile phone number, using a one-time code we send by text message. Message and data rates from your carrier may apply.
- Your Google account.
- Your Apple account.
Keep it accurate and secure. Choose a username that follows these Terms, and keep control of the phone number or account you sign in with. You are responsible for activity on your account. If you think someone else has accessed it, email legal@myrumr.com.
One person, one account holder. Do not share your account, sell it, or create accounts for other people without their permission. Do not create an account to get around a block or a ban.
Usernames. We may reclaim or change a username that impersonates someone, infringes a trademark, or otherwise breaks these Terms.
3. Your content
"Content" means anything you post, upload or send on RUMR: photos, videos, stories, captions, comments, messages, profile information and reports.
You own your content. Posting it on RUMR does not transfer ownership to us.
The license you give us. So that we can run RUMR, you grant Enovate Consulting, Inc. a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, copy, display, distribute, adapt (for example, resize, crop or compress), and transmit your content, only for the purposes of operating, providing, improving and protecting the Service. The sublicense right lets our service providers store and deliver your content for us. This license respects your privacy settings: we will not show a followers-only post to people who are not your followers.
When the license ends. The license ends when you delete the content or your account, except:
- Where your content has been shared with others and they still have it, such as messages you sent that remain in someone else's conversation.
- For a reasonable time needed to remove it from our systems and backups, as described in our Privacy Policy.
- Where we must keep it to comply with the law, or to investigate abuse or a violation of these Terms.
Your responsibility. You are responsible for your content. You confirm that you have the rights needed to post it, and that it does not violate these Terms, the law, or anyone else's rights, including copyright, trademark, privacy and publicity rights. If your content shows other people, you are responsible for having their permission.
We don't pre-screen. We do not review content before it is posted, and we are not responsible for content posted by users. We may review content when it is reported or when we believe it breaks these Terms.
4. Community rules
RUMR has zero tolerance for objectionable content and abusive users. You may not post, send or do any of the following on RUMR.
Harmful content
- Sexual content involving anyone under 18, or any content that sexualizes minors. We report child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
- Nudity or sexually explicit content.
- Threats, incitement to violence, or content that promotes terrorism or violent extremism.
- Graphic violence or gore shared to shock or glorify.
- Content that encourages or instructs suicide, self-harm or eating disorders.
- Hate speech or attacks on people based on race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability or serious disease.
- Sale or promotion of illegal drugs, weapons, or other illegal goods or services.
Harmful conduct
- Harassing, bullying, stalking or intimidating anyone, including through repeated unwanted messages.
- Sharing someone's private information (such as their address, phone number or intimate images) without their permission.
- Impersonating a person, brand or organization, or misrepresenting who you are in a way that misleads people.
- Spam, scams, fake engagement (such as buying likes or followers), or misleading links.
- Contacting someone who has blocked you through another account.
- Posting content that infringes someone else's copyright, trademark or other rights.
Misusing the Service
- Accessing another person's account, or trying to access data you are not allowed to see.
- Scraping, crawling or collecting data from RUMR by automated means, or using bots to create accounts or interact.
- Interfering with or disrupting RUMR, including uploading malware or overloading our systems.
- Reverse engineering, decompiling or bypassing security features of the app, except where the law allows it.
- Using RUMR for any illegal purpose.
5. Reporting and blocking
Reporting. You can report a profile, post, comment or message from inside the app. Reports are confidential: we do not tell the person who was reported who reported them. We review reports and aim to act on reports of objectionable content within 24 hours. Actions we may take include removing content, restricting features, or suspending or banning the account responsible.
Blocking. You can block any account. Once blocked, neither of you can see the other's profile, posts or stories, and they cannot message you. The person is not notified. You can see and undo blocks in Settings > Blocked accounts.
Emergencies. RUMR is not an emergency service. If you or someone else is in danger, contact local emergency services immediately.
6. Direct messages
- Messages are private between the people in a conversation, but they are not end-to-end encrypted. Our Privacy Policy explains when we may access them, such as to investigate a report.
- The community rules in section 4 apply to messages just as they apply to posts.
- When someone with a private account receives a message from you for the first time, it may arrive as a message request that they choose whether to accept.
- If you delete a message you sent, it is removed from the conversation for everyone. We cannot remove copies someone has already saved, such as a screenshot.
7. Stories
Stories disappear from the app 24 hours after you post them. Other people may still capture them, for example by taking a screenshot, while they are visible.
8. Notifications and text messages
- If you allow push notifications, we will send you notifications about activity on your account, such as new followers, likes, comments and messages. You can turn them off in your phone's settings.
- When you sign in with your phone number, you agree to receive a text message containing a one-time code. We do not send marketing text messages.
9. Copyright complaints
We respect intellectual property rights. If you believe content on RUMR infringes your copyright, email legal@myrumr.com with:
- Your name and contact information.
- A description of the copyrighted work.
- The username or a link to the content you believe infringes it.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
- Your physical or electronic signature.
We remove infringing content when appropriate and terminate the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you may send a counter-notice to the same address.
10. Our rights and the Service
RUMR belongs to us. The app, the RUMR name and logo, and the Service's design and software are owned by Enovate Consulting, Inc. and its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the RUMR app on your own device, as allowed by these Terms. You may not copy, modify or distribute the app, or use our name or logo without our written permission.
The Service will change. We may add, change or remove features at any time. We may also limit how much you can upload or store.
Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
11. Suspension and termination
You can leave at any time by deleting your account in Settings. Our Privacy Policy explains what happens to your information when you do.
We may act on your account. We may remove content, limit features, or suspend or permanently ban your account if:
- You break these Terms or the law.
- Your use creates risk or possible legal exposure for RUMR, our users or others.
- We are required to by law.
Where it is reasonable and safe to do so, we will tell you why. If you think we made a mistake, email legal@myrumr.com.
We may also stop offering RUMR entirely. If we do, we will give reasonable notice when we can.
Sections 3 (the parts about responsibility for content), 9, 10, 12, 13, 14 and 16 continue to apply after your account ends.
12. Disclaimers
RUMR is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not promise that RUMR will be uninterrupted, error-free or secure, that content will be stored without loss, or that content posted by other users is accurate, appropriate or safe. You use RUMR and interact with other users at your own risk. Always back up content you care about.
13. Limitation of liability
To the fullest extent allowed by law, Enovate Consulting, Inc. and its officers, employees, agents and service providers will not be liable for:
- Any indirect, incidental, special, consequential or punitive damages.
- Any loss of data, profits, revenue, goodwill or content.
- Content or conduct of any user or third party.
- Unauthorized access to or use of your account or content.
Our total liability for any claim relating to RUMR or these Terms is limited to the greater of $100 USD or the amount you paid us to use RUMR in the 12 months before the claim. RUMR is currently free, so in most cases the limit is $100.
Some places do not allow some of these limits, so they may not all apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
If you use RUMR in a way that breaks these Terms or the law, or infringes someone's rights, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees, to the extent allowed by law.
15. App stores
If you downloaded RUMR from the Apple App Store:
- These Terms are between you and Enovate Consulting, Inc., not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation for the app.
- Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims.
- You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded RUMR from Google Play, your use is also subject to Google Play's terms. Google is not responsible for the app.
16. Governing law and disputes
These Terms and any dispute relating to RUMR are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules.
Before filing a claim, please contact us at legal@myrumr.com so we can try to resolve it informally. If we cannot resolve it within 60 days, any lawsuit must be brought in the state or federal courts located in California, and you and we consent to the jurisdiction of those courts. This does not stop either party from bringing a qualifying claim in small claims court.
If you live outside the United States, you may also have rights under the laws of the country where you live that cannot be waived by these Terms.
17. Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows when they last changed. If a change is material, we will tell you in the app or by another reasonable method at least 14 days before it takes effect, unless the change is required by law or needed to address safety or abuse sooner. If you keep using RUMR after changes take effect, you accept the updated Terms. If you do not agree, delete your account.
18. General
- Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about RUMR.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of assets.
- No third-party beneficiaries, except as stated in section 15.
